Measure E: Apartment Complexes and Houses Will Be Charged the Same Rate

Measure E, a school-funding ballot measure, would originally have charged apartments per unit while charging a flat rate for houses.

Apartment complexes and single-family homes in Davis will both pay an extra $204 as part of Measure E, the recently passed school-funding ballot measure.

The measure would originally have taxed apartment complexes per unit, but the Davis school board this week decided to charge all types of properties the same rate.

Earlier this year, a state appeals court ruled against a similar Alameda schools parcel tax, saying it had to charge all properties the same rate. The state supreme court in June declined to review that case, finalizing the earlier decision.

Davis officials said in a statement that the Alameda case guided their decision.

"As a result, the District has decided to implement Measure E in a way that is consistent with [the Alameda case] by levying one uniform rate for all parcels of taxable real property," the Davis Joint Unified School District said in a press release. "On August 15, 2013, following a public hearing on the matter, the Board took action to ensure that all parcels of taxable real property will be assessed a uniform rate of $204 per parcel in accordance with [the Alameda case].  Exemptions for seniors and the disabled remain unaffected."

Davis residents have challenged Measure E in federal court, and that case is still pending, the Davis Enterprise reports.
