Could Larger Cell Towers Be Headed to Davis? City May Oppose State Bill

The Davis City Council may send a letter opposing AB 162.

Davis city staff members are warning of a state bill they say would allow wireless carriers to super-size their cell towers with little input from local officials.

The Davis City Council on Tuesday will consider sending a letter in opposition to AB 162, which a city staff report says would:

"Prohibit a state or local government from denying an eligible facilities request for amodification of an existing wireless tower, base station, or an existing wirelesstelecommunications facility that does not substantially change/modify the tower or basestation or the physical dimensions of the wireless telecommunications facility."

According to the city staff report, the bill's definitions of "substantial changes" could allow for cell towers to grow by 20 feet without any local input.

The report says the bill would hurt Davis.

"The City would lose the ability to provide for an open and transparent process that encourages public engagement," the staff report states. "The City could no longer thoroughly review projects or impose conditions of approval to ensure that proposed facilities are aesthetically compatible nor ensure that the health, safety and welfare ofthe community is protected."
